Basically PAN numbers is required to be obtained by a person whose income falls in the taxable limit and is liable for income tax payment.
Form 15- H is a form submitted by a person not having taxable income.
Hence both of these are normally not going together. So the logic of tax deduction @ 20% for those not having PAN number is illogical.
If the government actually wants all persons to have a PAN number, why don't we make it compulsory for all to have a PAN Card or issue a PAN card with address and biometric identification and then insist on this being used for all bank accounts/ transactions etc.
Another aspect is that this probably can avoid the TDS formalities since all payments are recorded towards a PAN number and government / income tax department can trace these payments clearly and claim tax on these.
Instead it is not logical to insist on TDS at source where the banks / companies making payment have to do a lot of extra work to deduct/pay and submit and upload TDS information etc without getting any compensation. ( Doing the work of IT dept without getting paid for it)
One more point is about the refund of excess tax paid, where the IT dept has been left free by the government with no answerability. They take their own time to make the refund and sometimes the refund cheques are not sent out, waiting for the assesses to come and collect it against a tip etc. Can an order be passed that the refunds are despatched from IT department within 6 months from the date of filing of returns if there are no querries and also put a deadline for seeking querries and disbursing the case within one year.

We support this petition.Our protest is on the unfair burden imposed on middle class, especially senior citizens, lack of clarity in directions & insufficient thought given to avoidable consequences, without corresponding awareness programme.
1. Almost as if to manage shortfalls in corporate direct tax collections, imposing TDS on bank FDs - the only avenue prefered by most senior citizens - in advance of bank interest payment is immoral , leading to erosion of capital even before interest payment starts.
2. Clarifications needed on how banks will manage to make good exess TDS made on provisional interest in the previous years.
3. Mandatory PAN, while ideal, is hard on senior citizens who have nil / low tax and are unaware of consequences of not having one, as PAN is generally thought, mistakenly yes, to be only for tax payers. It not only imposes penal rate of 20% TDS on non - compliance but one has also to quote it in all financial & economic transactions, including Form 15H for non-deduction of tax, Income Tax Returns, refunds claims, sale of moveable & immovable property, correspondence, bills, vouchers, documents and many more. To be subjected to such harsh measures, without simultaneously providing a non-cumbersome and quick mode of issue of PAN cards, like through their own banks and post offices, who can verify the necessary details , is both thoughless & inhumane.
4.Getting refunds is not as easy as the press releases suggest, as our own experience shows. We have five due, despite many reminders.
5. Not every one has access to computers in our country & full broad band connectivity is a dream .

I give a qualified support to this petition.I feel that as responsible Sr Citizens we should encourage any govt step that seeks to stop tax evasion. Compuslory requirement of PA.N No per se is not going to affect any one. This is necessary for the Tax man to track transactions for tax compliance. Secondly , now that tax filing has been made on linbe , it may not be such a problem for any one to file tax returns and get refunds even if there has been any tax deductions on interest payments etc.
Instewad of demanding a seperate dept/ministry in Govt, for Sr Citizens for addressing this tax issue, Income Tax dept may have designated officers to deal with Sr Citizens and assist in tax filing , refund claim etc
Let us suppoirt the Govt in their endeavour for better tax collections , knowing well that in India there are many millions who are still out of the tax net though their income is far higher. Also at issue is tax exemption given to Agricultural Income ,which should have been taxed like any other income, There is no logic for treating agri income differently,While poor farmers in any case are below tax limnit and some even below poverty line, this benefits only the rich farmers who really dont deserve it. So let us petetion for a just and equitable tax code and a clean tax administration free of corruption.

I support this petition. It is high time the Govt comes up with a separate Department for Senior Citizen Welfare, manned by personnel sensitive to the cause to look into all issues related to senior citizens.
