Complaint against BREACH OF TRUST, FRAUD AND CHEATING BY M/s Gupteshwar Colonizers Pvt. Ltd.

We, Hemant Kumar Saini & Smt. Lalita Saini R/o Delhi. This is a complaint against Rajasthan based company named M/s Gupteshwar Colonizers Pvt. Ltd., having its Registered Office at Opp. Dautawala Scheme, Panchait Samiti Road, DAUSA-303303 (Rajasthan). Mr. Trilok Chand Sain is Chairman and Mg. Director.
In the month of December, 2009, by selling our assets plus our life-time hard earned money added, On dated 27/12/2009, we had bought a Plot with full payment made at one stroke, in one of the upcoming residential projects of the above referred company M/s Gupteshwar Colonizers Pvt. Ltd., the Colony known as Triveni Nagar at Dausa-303303, Rajasthan. The possession is expected in Jan.2010.
Mr. Trilok Chand Sain was requested to us, you should wait for some time to complete the formalities of issuance of CLU of plot. We thought his request being genuine and accepted to wait as we had no alternative left since we was in desperate need of plot and the full payment towards the proposed plot was already made.
After completion of waiting period when we personally contact them at their office Dausa many times & began the follow-up for claim of our plot in his above referred colony known as Triveni Nagar, the said Colonizers on the pretext of one reason or the other started dilly-dally the matter and ignored/brushed-aside our repeated requests of execution of Title Documents in our favour. Their intention was not good.
We had many phone calls to Mr. Trilok Chand Sain, Chairman of the above Company. We regret to mention here that none of our phone calls was replied and the said Colonizers continued to maintain mysterious silence over the matter without any bonafide reasons for not performing his obligations under the law.
On dated 04/04/2010, After lot of postponing, the Colonizers decided to return our money back & gave us a cheque no. 613090, dtd. 13/04/2010, amount Rs. 1,21,000/- of Allahabad Bank, Dausa-0212251.
When we presented the said cheque on 13/04/2010 which was returned unpaid by drawee Bank vide returning Memo dated 11/05/2010 for the reasons `Insufficient Funds`. The said cheque was presented within its validity period and stood dishonoured on presentation.(enclosed Bank vide returning Memo photocopy)
We are a middle class family person and cannot afford the legal charges to approach the Court of Law. This is such a Stupid things in such a Democratic country this things has to be taken care by Hon. Supreme court of India and provide justice to the peoples and penalized these types of organizations.
We hereby, request you for taking necessary legal action against the aforesaid persons & get our hard earned money refunded, with bank interest.
